For non-birth parents: Can begin immediately

Benefits During Parental Leave

  • SDP medical coverage continues
  • Health and Welfare Fund benefits continue
  • Your position at your location is maintained
  • Leave is unpaid

Non-Birthing Parents

The parent who is not giving birth only has the option to take an unpaid 89-day parental leave. This leave continues medical benefits and provides job protection.

FMLA Coverage

Federal Family and Medical Leave Act protection

What is FMLA?

The Family and Medical Leave Act (FMLA) is a federal law that provides job-protected leave for qualifying family and medical reasons.

FMLA Eligibility

You are eligible for FMLA if you have:

  • Been employed by SDP for at least 12 months
  • Worked at least 1,250 hours in the prior 12 months

FMLA for Parental Leave

Duration

Up to 12 weeks of protected leave in a 12-month period

How It Works

  • FMLA runs concurrently with approved school district leave
  • If you have available paid leave (sick days or wage continuation), you will be paid for your time not working
  • If you do not have available leave time, FMLA provides unpaid job-protected leave
  • Provides job protection in case of intermittent absences due to medical leave

FMLA Is Not Required for Maternity Leave

Not everyone completes an FMLA application—it isn't a requirement for maternity leave. However, FMLA provides important job protection in case of intermittent absences or medical complications. Your maternity and parental leave are covered under FMLA when you meet eligibility requirements.
